Your Statutory rights are not affected by any of the following terms and conditions.
Services and Conditions of Use
As part of our service, we agree to provide you with information and other services that we may decide
to offer, subject to the terms of this agreement. Upon notice published through the service, we may
modify this agreement at any time. You agree and continue to agree to use our services in a manner
consistent with all applicable laws and regulations and in accordance with the terms and conditions set
out in the policies and guidelines outlined below. Please note that you will be referred to as "customer"
in this agreement.
Rules For Online Conduct
By using the service, you agree that you will not attempt to undermine the integrity of this web site.
Limitation Of Liability And Warranty
CUSTOMER AGREES THAT USE OF THE SERVICE IS ENTIRELY AT CUSTOMERS OWN RISK.
SERVICES ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS
OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION,
SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN
CONNECTION WITH THE SERVICE, INCLUDING WITHOUT LIMITATION THE SOFTWARE
LICENSED TO THE CUSTOMER AND THE RESULTS OBTAINED THROUGH THE SERVICE.
SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING WITHOUT
LIMITATION: 1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY OR
CONTENT OF INFORMATION, PRODUCTS OR SERVICES; AND 2) ANY WARRANTIES OF TITLE
OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY
FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT,
DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE
FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR
USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR,
NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. CUSTOMER SPECIFICALLY
ACKNOWLEDGES THE SERVICE IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR
ILLEGAL CONDUCT OF OTHER CUSTOMERS OR THIRD-PARTIES AND THAT THE RISK OF
INJURY FROM THE FOREGOING RESTS ENTIRELY WITH CUSTOMER.
NEITHER THE SERVICE NOR ANY OF ITS AGENTS, AFFILIATES OR CONTENT PROVIDERS
SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR
CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE OR INABILITY TO GAIN
ACCESS TO OR USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY. CUSTOMER
HEREBY ACKNOWLEDGES THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL
CONTENT ON THE SERVICE.
Trademarks
All trademarks appearing on the service are trademarks of their respective owners.
General Business Terms
Prices
ClassicFurniture4u.ee already designed to supply products for customers in Estonia, Sweden, Finland, Latvia and Lithuania.
All prices are including VAT. For a customers from EU we export without VAT. All prices are not include shipment. Transport cost will be added to the invoice after we confirm the delivery address. All prices are without obligation.
Shipping charges
Shipment of the goods provided by Transport company. Self pick up is also possible, but only from terminal in Tallinn.
Delivery is only made until Building / House.
The shipping agent of record is not forced to deliver goods to any floor above ground level.
Payment
Payment takes place immediately when order is placed for the goods. Payment is accepted by EU bank transfer, please find details on the Comercial Invoice. Invoice not include shipment. Transport cost depend from the size, quantity and destination. Transport cost will be added to the invoice after we confirm the delivery address. Sorry we do not accept any electronic payment and credit cards. Export orders should be paied in advance up on Comercial Invoice.
Retention of title
ClassicFurniture4u.ee claims enhanced ownership until the complete fulfilment of any outstanding debits.
Notification of defects
All our products are covered by our 12 month warranty.
The customer must check the goods for any defects immediately. If flaws or deviations of the quantity
are realised, they have to be reported to the shipping agent immediately, and they have to be set out
in writing. Flaws of any kind must be reported within 3 days of receiving the goods. If this is not
done, the delivered goods will be classified as correct regarding quantity and quality.
The warranty starts on the day following receipt of the product.
Warranty does not include buttons on sofas as they do have a tendency to catch on pockets etc so are
not associated to a manufacturing defect.
Damaged goods
If the customer receives damaged goods (damage through transport/manufacturing errors/missing parts etc.)
he has the right to receive substitution without further costs. Damages have to be reported in written
form or electronically (via e-mail) with images (where possible) within 3 working days. If the customer
fails to do so he may invalidate his claim.
Right of return
The customer has the right to return goods within 7 days of receipt. Informing ClassicFurniture4u.ee by
email to protect your time warranty. The right of return is with the exception
of the following articles: custom-made products, special offers , special orders
and price-reduced leftovers on stock.
Cancellation of Orders
Return transport
The customer is liable for the return transport costs unless the goods are proven to be faulty
(see the above). The customer must liaise directly with ClassicFurniture4u.ee to organise this
Arbitrary return transport by the self-importer as well as refusal to accept goods on delivery
is also charged to the customer. The cheapest way of transporting will be chosen.
Refusal of acceptance
If the customer refuses acceptance of delivery without our prior knowledge of the seller he will
be in breach of contract. As a direct result, the customer will be liable to pay complete freight
costs, as well as excess charges that have incurred to ClassicFurniture4u.ee
Recirculation of goods
Recirculation of goods will only be accepted in the original freight-boxes and the original slides.
So please keep the freight-boxes and slides after delivery.
Order
Your order can take place only per e-mail. Your order will be confirmed per e-mail
within 2 working days. From the point of confirmation your order will be legal obliging.
You can cancel your order up to 7 working days after receipt of our order-confirmation.
REPRODUCTIONS
Our reproductions of the classics are simply that "REPRODUCTIONS". Our reproductions of the
originals cannot and should not be called "ORIGINALS" by any of our resellers. In some cases
the original names might have been license copyright protection or trade mark thus all customer
must point out that the furniture is a reproduction not original all the classic furniture
is made to the highest standard matching the originals. |
